4. Lower-Cost Hosting, Outages & Data Loss

RGN provides independently operated, budget-oriented server hosting. One reason RGN can provide hosting at prices lower than many large commercial providers is that RGN does not necessarily provide enterprise data-center infrastructure or enterprise-level guarantees.

Unless specifically agreed otherwise in writing, RGN does not guarantee 100% uptime, redundant Internet, redundant electrical power, automatic failover, enterprise-level hardware redundancy, guaranteed recovery times, guaranteed backup intervals, 24/7 immediate support, or a contractual Service Level Agreement.

Downtime may result from Internet/ISP outages, power outages, hardware or storage failures, network or operating-system failures, game-server crashes, game updates, mod failures, maintenance, publisher/workshop outages, API/authentication failures, cyberattacks, or other circumstances outside RGN's reasonable control.

Server data may be corrupted, deleted, damaged, overwritten, or otherwise lost. Backups may be provided where available, but unless specifically included in the hosting arrangement, RGN does not guarantee that a backup will exist, be current, contain every file, or restore successfully.

To the maximum extent permitted by applicable law, RGN is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from downtime, data loss, service interruption, software failure, or inability to access the hosted service.

5. Support & Additional Services

Basic hosting support may be included. Additional labor may require a separate fee, including in-game administration, server configuration, mod work, scripting/development, backup restoration, data recovery, migration, operating-system/network/hardware troubleshooting, hardware replacement, and emergency or after-hours support.

When reasonably possible, RGN will notify the Client of additional fees before optional billable work begins. Parts, replacement hardware, licenses, third-party services, and shipping may be billed separately with Client approval.

I understand that work outside my included hosting services may require an additional fee.

I understand that troubleshooting, repair, restoration, or recovery charges cover the work performed and do not guarantee successful repair or data recovery.

7. Acceptable Use & Illegal Activity

RGN servers, computers, hardware, storage, networks, Internet connections, software, and other infrastructure may only be used for lawful purposes.

The Client may not use, attempt to use, or knowingly allow others to use RGN infrastructure for illegal or unauthorized activity.

Prohibited activity includes malware, ransomware, viruses, botnets, unauthorized access, attacks against networks or servers, fraud, scams, phishing, identity theft, illegal distribution or storage of copyrighted material, storage/distribution of material illegal to possess or distribute, using RGN systems to facilitate criminal activity, or any other activity prohibited by applicable law.

If RGN reasonably determines that a hosted service is being used for illegal activity or creates an immediate legal or security risk, RGN may immediately suspend or terminate the affected service without prior notice.

I understand that RGN infrastructure may not be used for illegal activity and that prohibited use may result in immediate suspension or termination.

8. Suspension & Termination

RGN may suspend, restrict, or terminate hosting for nonpayment, unpaid revenue share, fraudulent revenue reporting, illegal activity, abuse of RGN systems, malware/hacking/security threats, excessive resource usage, harassment or threats, unauthorized redistribution of RGN-owned tools, significant legal/financial/technical/security risk, or repeated/material breaches of this Agreement.

RGN may immediately suspend service without advance notice when continued operation presents an immediate legal, security, infrastructure, customer, or operational risk. For termination without cause, RGN will provide at least 30 days notice when reasonably practical.

Unless otherwise agreed, the Client may terminate hosting with 30 days written notice. Remaining hosted Client data may be permanently deleted 30 days after termination unless another arrangement is made.

I have read, understand, and accept RGN's suspension, termination, cancellation, and post-termination data terms.

9. Terms & Conditions Subject to Change

RGN may update or modify these Terms and Conditions as services, infrastructure, policies, operating costs, security requirements, legal requirements, or business operations change. RGN will make reasonable efforts to notify affected Clients of material changes.

A general update does not automatically change an individually agreed monthly hosting price, revenue-share percentage, or previously incurred payment obligation unless the Client agrees, the existing agreement permits the change with proper notice, or the change is otherwise permitted by applicable law.

RGN may make immediate policy changes when reasonably necessary for security, abuse prevention, legal/regulatory requirements, third-party requirements, or protection of RGN infrastructure.

I understand that RGN Terms and Conditions are subject to change as described above.

10. Third-Party Rules

RGN hosting does not authorize either party to violate applicable laws or the rules, licenses, monetization policies, or intellectual-property requirements of game publishers, platforms, mod developers, payment processors, Steam, Discord, Patreon, workshop services, or other third parties.

I understand that I remain responsible for complying with applicable game, mod, platform, payment, monetization, and intellectual-property rules.

11. Final Agreement & Electronic Acceptance

I have read and accept the RGN Server Hosting Terms and Conditions, Version 1.3.

I understand and accept the payment or revenue-sharing requirements applicable to my selected hosting plan.

I understand RGN's lower-cost hosting, outage, data-loss, backup, support-fee, acceptable-use, suspension, and termination policies.

I confirm that the information I provided is accurate to the best of my knowledge.
